Seller Terms of Service
These terms and conditions are the contract between you and LovetoTreat.co.uk (“us”, “we”, etc). By visiting, using and selling your products on Love to Treat.co.uk you agree to be bound by them.
Our agreement or contract
The relationship between LovetoTreat.co.uk and you (the Seller) is that: we act solely as your agent in that we collect money paid by your buyer or customer. We are not partners or joint ventures in business, we provide you with an online market place, subject to a yearly (365 days) subscription fee charged, if you place a product for sale on LovetoTreat.co.uk, you do so subject to our terms and our approval, although we are not a party to your contract with a buyer we shall remove any products from offer if a customer or site visitor has a valid complaint upheld by us, subject to this agreement you may enter a product or service for sale through LovetoTreat.co.uk. We may change this agreement in any way at any time without notice, the latest version can be found in the seller dashboard.
You agree: to not knowingly list any products for sale which are not of merchantable quality, items which may contain alcohol, or to post any personal information including contact details, name and addresses on any product listing. To make arrangements for the dispatch and delivery of your products, including all communications with the buyer, to indemnify us against any claim by any person in respect of any product, including reasonable management costs and legal fees, to indemnify us for any expense incurred by us in protecting the reputation of our businesses by making any payment to a customer of yours in circumstances where you have failed to make that repayment or comply with your contract with said customer, immediately to remove from sale any product which for any reason, you are unable to supply, not to replace any product which we remove from LovetoTreat.co.uk due to deeming it unsuitable for our website.
LovetoTreat.co.uk is not responsible for the fulfilment of your contract to sell or to deliver a product. You agree that a contract to sell a product offered by you is a binding contract as soon as your customer’s payment has been accepted by our payment service provider (Stripe). Every sale will be subject to the laws applicable but there shall not be implied any right which is not a legal right and which is not outlined in this document. Products will be offered for sale and sales made, subject to the terms and conditions applicable to buyers. You accept and endorse these terms and agree to comply in all respects with the obligations of a seller. We are simply the intermediary between the buyer and the seller. We can not be held accountable for your products or service.
You agree to comply with the details set out in your listing for your buyer to receive your product safely and efficiently. If you fail to deliver the product to your buyer, a dispute will opened via Stripe in and your funds may be withdrawn. We will send you an email message at the time of each sale, providing all information about that sale. You are responsible for checking your email, including junk folders for such emails. On the date of despatch, you will change the status of the order to notify both the customer and us. Product deliveries will be made from your premises, by post or by a carrier you have instructed. If at any time, any customer notifies you of non-delivery within the time scale offered by you on LovetoTreat.co.uk, you will immediately investigate and inform the buyer that you are doing so, what you are doing to resolve the issue, and when you expect the product to be delivered. You agree to despatch any product within 48 hours of receipt of order from us by a method likely to reach the buyer within a further 72 hours. If it becomes apparent that a customer has not received the product within the time frame of the delivery date expected, you will refund any money paid, including any delivery charge through Stripe. This is a condition of your contract with us to protect our reputation and your reputation as a seller.
You agree that you will: comply with the law relating to all aspects of the contract between you and your customer, reply promptly (within 24 hours) to any customer correspondence, when you have an obligation to return money to a customer for any reason, you will do so immediately in line with the contract, you will immediately inform your customer in the event that goods purchased are not available or become unavailable, provide all information to us in respect of any claim for non-delivery and any dispute as to payment, so as to enable us to identify the possibility of fraud.
You agree for LovetoTreat.co.uk or it’s agents to advertise, market or promote your product on social media sites including but not limited to Facebook and Instagram
By accepting a subscription to sell your products on LovetoTreat.co.uk – you agree to the following: We sell your product at the price you place on it, subject to these terms and subject also the requirements we set out in the seller dashboard. LovetoTreat.co.uk is an automated selling system which you can set-up and follow through the “Vendor Dashboard”. All payments and transactions between, us, you and the buyer are to be processed through Stripe, so that all transactions are recorded and in a case of a dispute. When making a sale on LovetoTreat.co.uk, to pay all fees applied by our payment processor (Stripe). You can view the current Stripe pricing at: https://stripe.com/gb/pricing. All seller subscription payments are non-refundable upon cancellation of the service, however your subscription can be upgraded at any time. We agree to charge 0% commission on sales until 31st March 2022, subject to you having a subscription package, however we reserve the right to increase this rate on or after this date.
You warrant that any product you place on LovetoTreat.co.uk for sale: is not: illegal, obscene, abusive, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to any third party, does not offend against the law of any country whose citizens might purchase it, you warrant that you own the copyright of any product you place on LovetoTreat.co.uk.
We will do all we can to maintain access to LovetoTreat.co.uk, however we offer no warranty that the service will be satisfactory to you. It may be necessary for us to suspend all or part of our service for repairs, or maintenance. We may do so without informing you first, however we will try to do this at non peak times. You acknowledge that our service may also be interrupted for reasons beyond our control. You agree that we are not liable to you for any loss whether foreseeable or not, arising as a result of interruption to our service.
We are not responsible for any loss, including loss of profits, revenue, data, goodwill or wasted expenditure, or any other indirect or consequential loss whatsoever. Nothing in these terms shall limit our liability for fraudulent misrepresentation, or for death or personal injury resulting from our negligence or the negligence of our employees or agents. You agree not to hold us responsible for things other users post or do. LovetoTreat.co.uk contains links to other external websites. We have no control over any of these websites. You acknowledge and agree that we shall not be liable in any way for the content of any linked website, or for any loss or damage arising from your use of any such websites. We are not liable in any circumstances for damages resulting from loss of use, loss of data or loss of revenues or profits, whether in an action of contract, negligence or otherwise, arising out of or in connection with your use of our website. We are now released by you from any and all claims and liability known or unknown, arising from any dispute between you and a buyer.
